The Town of North Smithfield ("Town") violated the APRA when it denied the Complainant's request to view a financial report, claiming it was an exempt correspondence to an elected official in his official capacity, pursuant to R.I. Gen. Laws § 38-2-2(4)(M). This Department determined that the financial report was not exempt because it did not qualify as a "correspondence" under the exemption. This Department directed the Town to respond to the Complainant's APRA request within ten (10) business days from the date of this finding in a manner consistent with this finding and the APRA.
