Attorney General Peter F. Kilmartin today issued a statement regarding the decision by a U.S. District Court in Washington, D.C., temporarily enjoining President Trump from banning transgender individuals from the military. Attorney General Kilmartin was one of 16 attorneys general that filed an amicus brief in the case, Doe v. Trump, opposing the Trump Administration's plans to ban open military service by transgender individuals.
Responding to the decision, Attorney General Kilmartin said:
"Today's decision marks a significant victory for transgender individuals who serve in our military forces. Commitment to protecting this great nation at home and abroad, serving with honor and dignity, treating your brothers and sisters in uniform with respect, and patriotism are all conditions to serve in our military. Conforming to a specific gender identity in order to serve is arbitrary and, as the judge notes, is not a condition to serve.
Trump's reasons for banning transgender individuals from the military had nothing to do with their ability to serve, but rather a politically-motivated disapproval of transgender people in general. That is called discrimination and has no place in our military or our community."
