The Statewide Grand Jury reported out an indictment charging Troy Gunderway and Richard Baribault each with one count of murder and conspiracy to commit robbery. The Grand Jury also indicted Baribault with receiving stolen goods under $1,500, driving on a suspended license, and possession of a knife.
It is alleged that on or about August 1, 2015, Gunderway and Baribault murdered 70-year-old Fernando Silva, also known as Captain Fredy, on his boat in Warwick Cove while they were allegedly trying to steal Silva's earlier Keno winnings. It is further alleged on or about August 19, 2015, Baribault was operating a motor vehicle on a suspended license and was in possession of stolen goods and a knife with a blade of more than three inches in length.
The Warwick Police conducted the investigation. Both Gunderway and Baribault have been held without bail since their arrest and are scheduled to be arraigned in Kent County Superior Court on February 19, 2016.
